Felicia R. Reid is a partner in the firm’s San Francisco office, and heads the firm’s Wage and Hour practice group. Her practice focuses on both litigation and practical day-to-day advice and counsel to employers not only in the wage and hour arena, but also on the full range of labor and employment law matters. She has extensive experience representing employers before state and federal courts and agencies in cases involving wage/hour, discrimination, wrongful termination, reasonable accommodation, leave of absence, WARN Act, workplace violence, and employee privacy claims. She has a particular expertise in appellate practice and has been involved in a number of significant appellate cases, including Gieg v. DRR, 407 F.3d 1038 (9th Cir. 2005), Mukhtar v. California State University, Hayward, 319 F.3d 1073 (9th Cir. 2003), and Smith v. Rae-Venter Law Group, 29 Cal.4th 345 (2002). Ms. Reid is a former law clerk to Judge Robert Boocheever of the U.S. Court of Appeals for the Ninth Circuit. An active participant in the Labor and Employment Law Section of the American Bar Association and its Fair Labor Standards Legislation Committee, she is a contributing editor to a number of national employment law treatises, Employment Discrimination Law (BNA 3rd Ed. 1996); The Fair Labor Standards Act, 2007 Cumulative Supplement (BNA 2007); Age Discrimination in Employment Law, 2007 Cumulative Supplement (BNA 2007); and The Family and Medical Leave Act, 2008 Cumulative Supplement (BNA 2008).
Representative Matters
- Obtained nuisance settlement to named plaintiff only in wage/hour class action alleging overtime and missed meal and rest periods brought by prominent plaintiff’s firm after convincing them that claims had no merit and prior to our client incurring significant attorneys’ fees.
- Defeated class certification in state-wide wage/hour class action for alleging unpaid travel time and minimum wage, convincing court that individual issues among class members predominated.
- Obtained summary judgment in sexual harassment case alleging course of offensive behavior, convincing court that plaintiff’s reactions reflected cultural differences between complainant and accused rather than those of a reasonable woman.
- Obtained complete appellate reversal of $1.9 million punitive damages award in wrongful termination lawsuit, due to insufficient evidence of corporate ratification.
- Convinced California Supreme Court that employers are entitled to their attorneys’ fees in defending against unsuccessful appeals under Berman wage claim process.
- Managed numerous wage/hour compliance audits, including review of overtime classifications and reclassification strategies, for employers ranging from large multinational high technology companies, to national non-profit corporations, to small and mid-sized companies.
